Turkish steel pipe producer Borusan Mannesmann Boru Sanayi ve Ticaret AS and its subsidiary Borusan Mannesmann Pipe US Inc. on Wednesday lost a challenge to the Commerce Department’s interpretation of how tariffs imposed by the Trump administration impacted other US duties.

Borusan was already subject to decades-old antidumping duties for Turkish carbon steel pipe when Proclamation 9705 was issued in 2018. The proclamation separately imposed a 25% tariff on imported steel articles, including Borusan’s pipe, in the interest of national security under the authority of Section 232 of the Trade Expansion Act of 1962.
